Section 504 (The Rehabilitation Act of 1973)

Section 504 is a civil rights law that provides federal funding for general education. The purpose is to protect the rights of individuals with disabilities in programs and activities that receive federal assistance from the department of education. Section 504 requires a written accommodation plan. A student may be eligible for accommodations under a 504 Plan if he or she has a physical or mental health disability that limits one or more major life functions. Students with a disability are to be provided the same opportunity to benefit from education programs, services and activities as their nondisabled peers.

Under the Section 504, a school district must conduct an evaluation to determine if a child qualifies and to determine needed accommodations and modification. Under Section 504 of the Rehabilitation Act, a disability is defined as:

  1. Has a physical or mental impairment that “substantially” limits one or more major life activity (such as reading or concentrating).
  2. Has a record of the impairment.
  3. Is regarded as having an impairment, or a significant difficulty that is or is not temporary.
  4. A child on a health plan is covered under Section 504 or the Rehabilitation Act.
